These Terms of Service govern all prepaid eSIM sales and services provided by PENTHOS LLC (“we”, “Service Provider”). These terms apply to all users (“Customer”, “you”) who visit our website, use our services, or purchase an eSIM from us.
1. Acceptance of Terms
By using our website or accessing our services, you acknowledge that you have read, understood, and accepted these Terms of Service. PENTHOS LLC reserves the right to update these terms at any time. Updated terms become effective on the date they are published on our website.
2. Description of Services
PENTHOS LLC provides prepaid eSIM services for domestic and international use. These services include eSIM sales, digital delivery, activation processes, user support, and technical assistance.
3. Eligibility
To use our services, you must be at least 18 years old and legally capable of entering into a binding agreement.
4. Account Creation and Accuracy of Information
Some services may require you to create an account. You are responsible for ensuring that your account information is accurate, complete, and up to date. All transactions conducted through your account shall be deemed to be performed by you unless proven otherwise.
5. Pricing and Payment
All product and service prices are clearly displayed on our website.
Full payment must be completed in order to access the services.
Accepted payment methods and transaction security details are available on our website.
6. Delivery
eSIMs are delivered digitally after payment confirmation. Delivery time may vary depending on the device used, system load, and technical compatibility.
7. Device Compatibility
The Customer is responsible for verifying that their device is eSIM-compatible and not network-locked (SIM-locked).
PENTHOS LLC shall not be held liable for issues arising from incompatible devices or installation errors caused by the user.
8. Refund and Cancellation Policy
Services provided by PENTHOS LLC are digital products (eSIMs).
8.1. Cancellations- Subscriptions & Services: You can cancel a Subscription or recurring service at any time with effect from the end of your current billing period.
- Effect of Cancellation: Your cancellation will take effect at the end of your current billing period, and you will not be charged again after that. You will retain access to your plan until the end of the paid period.
- How to Cancel: You can cancel your Subscription directly through the Buyer Portal (accessible via the link in your purchase confirmation email) or by submitting a cancellation request to our support team.
8.2. Refunds and Statutory Withdrawal Rights
Because eSIMs are delivered digitally and instantly, refunds are generally not provided once the service is activated or data usage has commenced.
However, in accordance with applicable statutory rights and our service commitment, refund requests may be evaluated under the following exceptional cases:- Failure to activate or install the eSIM due to an unresolvable technical issue.
- System-related service failures caused directly by PENTHOS LLC or our underlying network providers.
8.3. Refund Conditions & Eligibility
To be eligible for a refund review, the following conditions must be met:- Written Request: You must submit your request in writing within 14 days of the original purchase date.
- Technical Cooperation: You must cooperate with our support team during the technical review and troubleshooting process.
- Unused Service Status: If the eSIM profile installation is completed or data usage/consumption has started, the service is deemed fully delivered and used. No refunds will be issued in these cases.
- Assessment: All refund requests are reviewed on a case-by-case basis and assessed in good faith. Approved refunds will be processed back to the original payment method through our Merchant of Record (Paddle).
9. Privacy
Your personal data is processed and protected in accordance with our Privacy Policy. For more information, please review the Privacy Policy available on our website.
10. Intellectual Property
All texts, logos, images, designs, and other content on the website are the property of PENTHOS LLC.
Such content may not be copied, reproduced, or used for commercial purposes without prior written permission.
11. Limitation of Liability
PENTHOS LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the services. The services are provided on an “as is” basis.
12. Governing Law and Jurisdiction
PENTHOS LLC is operated by a company based in the United States.
These Terms of Service are governed by and construed in accordance with the laws of the United States. The parties agree that the courts of the United States shall have exclusive jurisdiction over any disputes.
For users residing in Türkiye, statutory rights arising from Turkish consumer protection laws remain reserved.
